Privacy Notice

 

This privacy notice is provided to inform about how and why your personal data is used so that we can be as transparent as possible, and to ensure that you are aware of your rights under data protection legislation. 

 

The Company

We are Paytek Administration Services Limited and, in most instances, we will be the data controller, as defined under the UK General Data Protection Regulation (UK GDPR), of any personal data which we collect from or about you. The purpose for processing your data and our basis for doing so.

We process your personal data so we can offer and provide support services to independent sales organisations and their merchant customers.

 

When we process your personal data, we must establish our legal basis for doing so and that legal basis can be different depending on circumstances in which we process it. You will see references to the basis of processing e.g.,"(Article. 6.1.f)" and this is a reference to the article of the UK GDPR under which we undertake the processing in question.

 

When a company registers with us as an Independent Sales Organisation, we will process the names, dates of birth and home addresses of the directors, partners, proprietor or major shareholder. We require this information to set up the contract between us as well as undertake due diligence checks. The lawful basis we use for this processing is Article 6.1.b – Performance of a Contract and Article 6.1.c – Legal Obligation.

 

For us to put in place a payment process services agreement with the merchant customers, we will process the name, email address and telephone number(s) of the merchant as well as the position the individual holds in the business. Our lawful basis for this processing is Article 6.1.b – Performance of a Contract

 

If you fail to provide the information required, we will be unable to provide the agreed services to you.

 

We may collect information about you from fraud prevention agencies and other organisations when we undertake checks such as identification verification checks, as explained further below.

 

Information may also be collected about you when you visit our websites (for example via cookies), such as your IP address and other browser-generated information.

 

Recipients of your data

 

As a general principle, we will not transfer your personal data to other recipients without your permission. There are some exceptions to this: 

  • It is possible, that we might be obliged to disclose personal information in response to a court order or other lawful obligation. Our lawful basis for this is Article 6.1.c -legal obligation. 

  • We may share personal data with funders through a finance agreement – Article 6.1.b – performance of a contract.

 

Data processed by third parties on our behalf. 

 

We use the services of other organisations in the processing your data. We use cloud-based email and document storage, video conference platforms. Our website processes limited personal data such as through our contact form. We have an outsourced IT function which from time to time, has access to personal data stored on our systems. We also utilise a CRM system specific to our sector.

 

Those organisations that process personal data on our behalf are subject to a data processing contract as required by Article 28 of the UK GPDR. This ensures that your data is handled in accordance with the UK GPDR.

 

Transferring your data outside of the UK

 

Personal data may be transferred to countries outside of the UK to countries outside the European Economic Area (EEA) whose Data Protection Laws may not be as extensive as those which apply to us. Where we do so, we will ensure that we do this in accordance with the UK GDPR (or other relevant data protection legislation) and take appropriate measures to ensure that the level of protection which applies to your personal information processed in these countries is similar to that which applies within the EEA. Such measures may include only transferring your data to jurisdictions in respect of which there is an adequacy decision or, where this is not the case, by using model clauses which have been approved by the European Commission.

 

Retention periods 

 

We will only retain your personal data for as long as we require it in order to fulfil the purposes stated above and / or where we have a legal obligation or other legitimate purpose to do so.  Generally, we will retain copies of the contracts with, and the personal data of, ISO’s and merchants for the duration of the contract and for a further 7 years thereafter to enable us to deal with any legal issues and will retain the information provided to us for identification verification checks, financial crime and anti-money laundering checks (as required by law) for not less than 5 years after termination or expiry of the relevant contract. 

 

Your rights 

 

The UK GDPR provides you with several rights in relation to the data of your we process (unless exemptions apply). These include:

 

  • the right to get access to and copies of your personal data.

  • the right to ask us to rectify any inaccurate information we may be holding. 

  • the right to ask us to restrict the data we are processing.

  • the right to data portability for data we process under the lawful basis of ‘contract’

 

When you contact us to exercise any of the rights above, we may ask you to provide some additional information in order to verify your identity, such as your name, your address and proof of identity.
